These Terms & Conditions set out the rules for using the website of the brand "Nika Mała Weterynarka", available at [WEBSITE URL], purchasing digital products and using ebooks, PDF files and other educational materials made available through the website. By using the website or making a purchase, the user accepts these Terms & Conditions.

Sales take place online and concern digital products, in particular ebooks, PDF files and educational materials.

Section 02

Digital Products

The website offers digital products, in particular ebooks, PDF files, educational materials and other digital content related to the brand "Nika Mała Weterynarka".

The materials may concern veterinary topics, animal care, children's education, the daily work of a veterinarian and developing interest in the world of animals.

Products are delivered only in digital form. We do not send physical products, printed books or physical storage media.

The product description, price, scope of content, format and main features are presented on the product page before purchase.

Section 03

Educational Nature of the Content

The products available on the website are educational, informational and recreational in nature.

The materials, including ebooks for children, do not replace an individual consultation with a veterinarian, diagnosis, treatment or professional advice tailored to a specific animal.

In the event of illness, injury, worrying symptoms or doubts concerning an animal's health, a veterinarian should be consulted.

Some content may have been prepared using artificial intelligence tools and then developed, checked, edited or supplemented with human involvement. We make efforts to ensure that the materials are friendly, reliable and educationally valuable, but they should be treated as educational support and not as individual veterinary advice.
Section 04

Purchase by Adults

The products available on the website may be intended for children, parents, guardians and people interested in veterinary education.

A product may be purchased only by an adult or by a person acting with the consent of a parent or legal guardian.

We do not direct the purchase process directly to children and we do not intend to collect children's personal data.

Section 05

Purchase and Payments

Purchases are made online. Payments are handled by Paddle as Merchant of Record. This means that Paddle may act as the formal seller of the transaction and may be responsible for handling payments, taxes, invoices and selected transaction-related matters.

During the purchase, the user may also be required to accept Paddle's terms.

The button completing the purchase process must clearly indicate that the order involves an obligation to pay, for example by using the wording "Order and pay" or an equivalent phrase.
Section 06

Price and Promotions

The product price is visible on the product page before purchase.

If a promotion, price reduction, discount code, sale, crossed-out price or any other message suggesting a price reduction is announced on the website, the lowest price of that product from the 30 days before the price reduction should be displayed next to the product, in accordance with applicable law.

If the product has been offered for sale for less than 30 days, the lowest price of that product from the start of sale until the price reduction should be displayed.

Section 07

Functionality and Compatibility of the Digital Product

Digital products are delivered in PDF format, unless the description of a specific product states otherwise.

To use the product, the user needs a device capable of opening PDF files, such as a computer, tablet, smartphone or PDF-compatible reader, as well as suitable software for reading PDF files.

The product may be protected against unauthorised copying, distribution or editing, including by author markings, watermarks, copyright notices or other technical protection measures.

Digital products are not delivered on a physical medium.

Section 08

Automatic Delivery of the Digital Product by Email

After the order has been properly paid for, the digital product will be sent automatically to the email address provided by the user during purchase.

The email may contain the purchased PDF file as an attachment, a download link or another solution allowing access to the purchased digital product.

The digital product is delivered automatically and immediately after payment is completed, provided that before purchase the user has consented to the immediate delivery of digital content before the end of the withdrawal period and has confirmed that they acknowledge the loss of the right of withdrawal once delivery of the digital product begins.

Confirmation of the contract, information about the purchased product and confirmation of consent to immediate delivery of digital content will be sent to the user electronically to the email address provided during purchase.

The user is responsible for providing a correct email address during purchase. If the email does not arrive, goes to the spam folder, the link does not work or the file does not open correctly, the user should contact us at: hello.nikavet.support@gmail.com · +48 510 221 650

Section 09

Licence for Individual Customers

By purchasing an ebook, PDF file or other digital product, the user receives a personal, non-exclusive, non-transferable and non-commercial licence to use the product only for personal use.

The purchase of the product does not transfer copyright to the user.

Without our express written consent, the user may not:

  • send the product to other people
  • make the product publicly available
  • publish the product on the Internet
  • copy the product for further distribution
  • resell the product
  • use the product commercially
  • include the product in paid courses, groups, subscriptions or materials of their own business
  • share the product on forums, groups, online drives, social media or messaging apps
  • remove author markings, watermarks, copyright notices or other protections
  • modify the product and present it as their own
Section 10

Licence for Clinics, Practices and Business Users

In the future, the website may offer a subscription or access option for veterinary clinics, practices, animal hospitals or other business entities.

As part of an active subscription, a clinic may receive a limited right to use selected ebooks or educational materials and to share them with its clients or animal guardians only within the scope specified in the relevant offer.

Unless the specific offer states otherwise, the clinic may not:

  • resell the materials as its own products
  • publish the materials publicly on a website
  • publish the materials publicly on social media
  • transfer the materials to other clinics, companies or entities
  • remove information about the author, brand, source or copyright
  • modify the materials and present them as its own
  • use the materials after the subscription has ended, unless the specific offer clearly allows it

Detailed terms of clinic subscriptions, including the number of users, scope of sharing, duration of access, price and method of using the materials, will be specified in the relevant offer description or a separate agreement.

Section 11

Refunds and Withdrawal from the Contract

Products sold on the website are digital content delivered online and not supplied on a tangible medium.

As a rule, a consumer has the right to withdraw from a distance contract within 14 days. However, in the case of digital content, this right may be lost once delivery begins, if the conditions required by law are met.

Because the purchased ebook, PDF file or other digital product is sent automatically to the user's email address immediately after payment, before purchase the user must consent to the immediate delivery of digital content before the end of the withdrawal period and confirm that they acknowledge the loss of the right of withdrawal once delivery of the digital product begins.

After the digital product has been sent to the email address provided during purchase or after a download link has been made available, the sale is generally final. The user may not withdraw from the contract solely because of a change of mind, accidental purchase, lack of time to use the product or dissatisfaction resulting from subjective expectations.

This does not limit the consumer's mandatory statutory rights, in particular in the case of non-delivery of the product, technical problems preventing access to the product or non-conformity of the digital content with the contract.

Section 12

Required Checkbox When Purchasing a Digital Product

Before purchasing a digital product with immediate delivery, the user must tick the following consent checkbox:

"I consent to the immediate delivery of digital content to my email address before the end of the withdrawal period and acknowledge that, once the digital product has been sent or a download link has been made available, I lose my right of withdrawal from the contract."

This consent must be clear, separate, voluntary, required for immediate delivery of the digital product and not pre-selected by default. It must not be hidden only in the Terms & Conditions.

The customer may not complete a purchase with immediate delivery of the digital product and receive the product automatically by email unless the above checkbox is ticked.

Section 13

Complaints and Non-conformity of Digital Content

The user may submit a complaint if the digital product has not been delivered, does not work properly, cannot be opened despite meeting the technical requirements, or is not consistent with the product description.

In the complaint, it is helpful to include:

  • first name and surname
  • email address used during purchase
  • date of purchase
  • product name
  • description of the problem
  • if possible, a screenshot or other information helping to explain the issue

After receiving the complaint, we will take reasonable steps to resolve the problem, in particular by making the file available again, sending a correct link, resolving the technical issue or taking another action in accordance with applicable law.

Section 14

Out-of-court Dispute Resolution

A consumer may use out-of-court methods of handling complaints and pursuing claims, if such a method of dispute resolution is available under applicable law.

Information on out-of-court methods of resolving consumer disputes in Poland is available on the websites of the Office of Competition and Consumer Protection and the relevant consumer institutions.

Using out-of-court dispute resolution methods may require the consent of both parties to the dispute, unless the law provides otherwise.

Section 15

User Responsibility

The user is responsible for using the products in accordance with these Terms & Conditions, applicable law and the licence rules.

The user is responsible for keeping download links, files and access data confidential, if such data is provided.

In the event of a licence breach, in particular unauthorised sharing, resale or publication of the product, we may take appropriate action, including pursuing claims through legal means.

Section 16

Copyright and Rights to Content

The content available on the website, including ebooks, PDF files, texts, graphics, illustrations, layout of materials, product names and other elements, may be protected by copyright or other intellectual property rights to the extent provided by applicable law.

The purchase of a product does not transfer copyright to the user. The user receives only a licence to use the product within the scope specified in these Terms & Conditions or in a specific offer.

Section 17

Prohibited Actions

The user may not:

  • use the website in a manner contrary to law
  • infringe copyright or other intellectual property rights
  • attempt to gain unauthorised access to the website, systems or accounts
  • copy, automatically download or scrape content from the website
  • distribute products without consent
  • use products in a misleading manner
  • suggest that they are the author of the product or that they have the right to resell it
Section 18

Changes to Products and the Website

We may update, change or withdraw products and content available on the website.

The purchase of a specific product does not automatically entitle the user to future updates, new versions or additional materials, unless the product description or offer clearly states otherwise.

Section 19

Limitation of Liability

We make efforts to ensure that the materials are reliable, friendly and educationally valuable, but we do not guarantee that they will be suitable for every individual situation.

We are not responsible for decisions made by the user solely on the basis of educational materials without consulting an appropriate specialist, in particular a veterinarian.

We do not exclude or limit liability to the extent that such exclusion or limitation would be prohibited under applicable law.

Users' personal data is processed in accordance with the Privacy Policy available on the website.

Governing Law

These Terms & Conditions are governed by Polish law, subject to mandatory consumer protection laws that may apply in the consumer's country of residence.
